1. Acceptance of Terms
Welcome to Smart Printer. By downloading, installing, or using our mobile application, you agree to be bound by these Terms of Use ("Terms"). If you do not agree to these Terms, please do not use the app.
These Terms constitute a legally binding agreement between you and Almer Technologies ("Provider," "we," "us," or "our").
2. Description of Service
Smart Printer is a mobile application that provides printing and document scanning tools, including:
- Printing documents, photos, and web pages from your device to compatible Wi-Fi and network printers
- Scanning documents using your device camera
- Converting and preparing files for printing
- Printing content shared from other apps through the share extension
- Managing your print history and saved documents on your device
3. Eligibility
You must be at least 13 years old (or 16 in the European Union) to use Smart Printer. By using the app, you represent and warrant that you meet this age requirement. If you are under 18 years old, you must have permission from a parent or legal guardian to use the app.
4. Account Registration and Security
4.1 Account Creation
- You must create an account using a valid email address to use certain features.
- You are responsible for maintaining the confidentiality of your account credentials.
- You agree to provide accurate and complete information during registration.
4.2 Account Security
- You are solely responsible for all activities that occur under your account.
- You must immediately notify us of any unauthorized use of your account.
- We are not liable for any loss or damage arising from unauthorized account access.
4.3 Account Termination
- You may delete your account at any time through the app settings or by contacting us.
- We reserve the right to suspend or terminate accounts that violate these Terms.
5. Subscription and Payments
5.1 Premium Features
Smart Printer offers premium features through paid subscriptions, including:
- Weekly subscriptions
- Monthly subscriptions
- Promotional offers
5.2 Payment Terms
- Subscriptions are processed through the Apple App Store or Google Play Store.
- All payments are handled by Apple or Google, and their terms apply.
- Prices are displayed in your local currency and include applicable taxes.
5.3 Subscription Renewal
- Subscriptions automatically renew unless canceled at least 24 hours before the end of the current period.
- Your account will be charged for renewal within 24 hours before the end of the current period.
- You can manage or cancel subscriptions through your App Store or Google Play account settings.
5.4 Refunds
- Refund requests must be submitted through the App Store or Google Play Store.
- We do not control refund policies set by Apple or Google.
- Generally, refunds are granted at the discretion of Apple or Google.
5.5 Free Trials
- Some subscriptions may offer free trial periods.
- You may cancel during the trial period to avoid charges.
- Your payment method will be charged when the trial period ends unless canceled.
6. User Conduct and Prohibited Activities
You agree NOT to:
- Use the app for any illegal or unauthorized purpose.
- Violate any laws in your jurisdiction.
- Upload malicious code, viruses, or harmful software.
- Attempt to reverse engineer, decompile, or disassemble the app.
- Use automated systems or bots to access the app.
- Interfere with or disrupt the app's functionality or servers.
- Impersonate any person or entity.
- Collect or harvest personal data of other users without consent.
- Use the app to spam, harass, or threaten others.
8. Intellectual Property Rights
8.1 Ownership
- Smart Printer, including all content, features, and functionality, is owned by Almer Technologies.
- The app is protected by copyright, trademark, and other intellectual property laws.
8.2 Limited License
- We grant you a limited, non-exclusive, non-transferable, revocable license to use the app for personal, non-commercial purposes.
- You may not copy, modify, distribute, sell, or lease any part of the app.
- You may not create derivative works based on the app.
8.3 Trademarks
- "Smart Printer" and related logos are trademarks of Almer Technologies.
- You may not use these trademarks without prior written permission.
9. Content and Data
9.1 User Content
- You retain ownership of any data or content you upload to the app.
- By uploading content, you grant us a license to use, process, and analyze it solely to provide the service.
9.2 Accuracy of Information
- We strive to provide an accurate service, but we do not guarantee the accuracy, completeness, or reliability of any information.
- Results are based on the data you provide and may contain errors.
9.3 Data Retention
- Your documents are processed on your device and are not stored on our servers. Scans and print history remain on your device until you delete them.
- Account data is retained as long as your account is active.
- You can request data deletion at any time.
10. Disclaimers and Limitation of Liability
10.1 "As Is" Service
- The app is provided "as is" and "as available" without warranties of any kind.
- We do not guarantee that the app will be error-free, secure, or uninterrupted.
- We do not warrant that defects will be corrected.
10.2 Third-Party Hardware and Services
- Smart Printer is an independent app and is not affiliated with, endorsed by, or sponsored by any hardware manufacturer.
- We are not responsible for third-party hardware, drivers, or services that may affect the app's functionality.
10.3 Limitation of Liability
TO THE MAXIMUM EXTENT PERMITTED BY LAW:
- We are not liable for any indirect, incidental, special, consequential, or punitive damages.
- We are not liable for any loss of profits, revenue, data, or use.
- Our total liability shall not exceed the amount you paid for the subscription in the last 12 months, or $100, whichever is less.
10.4 Indemnification
You agree to indemnify and hold harmless Almer Technologies from any claims, damages, losses, liabilities, and expenses arising from your use of the app or violation of these Terms.
11. Privacy
Your use of the app is also governed by our Privacy Policy, which is incorporated into these Terms by reference. Please review the Privacy Policy to understand our data practices.
12. Changes to Terms
We reserve the right to modify these Terms at any time. We will notify you of significant changes through the app or via email. Your continued use of the app after changes constitutes acceptance of the updated Terms.
13. Termination
13.1 Termination by You
You may stop using the app and delete your account at any time.
13.2 Termination by Us
We may suspend or terminate your access to the app at any time, with or without cause, including for:
- Violation of these Terms
- Fraudulent or illegal activity
- Abuse of the service
- Non-payment of subscription fees
13.3 Effect of Termination
Upon termination:
- Your right to use the app immediately ceases.
- We may delete your account and data.
- You remain liable for any outstanding obligations.
14. Governing Law and Dispute Resolution
14.1 Governing Law
These Terms are governed by the laws of Turkey, without regard to conflict of law provisions.
14.2 Dispute Resolution
- Any disputes arising from these Terms or the app shall be resolved through binding arbitration.
- You agree to waive the right to a jury trial or to participate in a class action lawsuit.
- Before filing a claim, you agree to attempt to resolve the dispute informally by contacting us.
15. Miscellaneous
15.1 Entire Agreement
These Terms, together with the Privacy Policy, constitute the entire agreement between you and Almer Technologies.
15.2 Severability
If any provision of these Terms is found to be invalid or unenforceable, the remaining provisions shall remain in full force and effect.
15.3 Waiver
Our failure to enforce any right or provision of these Terms shall not be deemed a waiver of such right or provision.
15.4 Assignment
You may not assign or transfer these Terms without our prior written consent. We may assign these Terms without restriction.
15.5 Force Majeure
We are not liable for any failure or delay in performance due to circumstances beyond our reasonable control.
17. App Store Terms
Your use of the app is also subject to the terms and conditions of the Apple App Store or Google Play Store, as applicable.
By using Smart Printer, you acknowledge that you have read, understood, and agree to be bound by these Terms of Use.
